Does FMLA Cover Mental Health Treatment in Tennessee?

Reviewer: Mo Raja

Yes. The federal Family and Medical Leave Act covers mental health treatment in Tennessee. An eligible employee may take up to 12 workweeks of unpaid, job-protected leave in a 12-month period for a serious mental health condition, whether the care is delivered as inpatient treatment or as ongoing outpatient treatment by a health care provider. The employer must maintain the employee’s group health coverage during the leave and return the employee to the same or an equivalent position afterward. The U.S. Department of Labor confirms in Fact Sheet #28O that mental health conditions qualify on the same basis as physical ones. Tennessee has no separate state medical leave law for a person’s own serious health condition, so federal FMLA is the governing entitlement.

Quick answer

FMLA treats mental and physical health the same. Depression, anxiety, post-traumatic stress disorder, bipolar disorder, and similar conditions qualify when they meet the definition of a serious health condition. Leave can be taken in one continuous block or intermittently for therapy appointments and periods of incapacity. Estimate your own entitlement with the Tennessee FMLA Calculator.

What Counts as a Serious Mental Health Condition Under FMLA?

A mental health condition qualifies as a serious health condition when it meets one of two tests set out in federal regulation and in DOL Fact Sheet #28O.

1. Inpatient care

An overnight stay in a hospital or residential medical facility, including a psychiatric hospital, a crisis stabilization unit, or a treatment center for an eating disorder or co-occurring substance use disorder, plus any related period of incapacity.

2. Continuing treatment

A condition that incapacitates a person for more than three consecutive days and requires ongoing care, or a chronic condition such as anxiety, depression, or a dissociative disorder that causes occasional periods of incapacity and requires periodic visits to a provider.

Continuing treatment can be provided by a psychiatrist, a clinical psychologist, or a clinical social worker, and it includes prescription medication management, psychotherapy, and structured outpatient programming. A single appointment followed by a course of medication or therapy can satisfy the test.

Who Is Eligible for FMLA Mental Health Leave in Tennessee?

The eligibility rules are the same for a mental health condition as for any other serious health condition. Four conditions must all be true on the day the leave begins.

Employer size

The employer has 50 or more employees within 75 miles of your worksite.

Length of service

You have worked for that employer for at least 12 months, which need not be consecutive.

Hours worked

You worked at least 1,250 hours in the 12 months before the leave, roughly 24 hours a week.

Qualifying reason

The leave is to receive treatment for a serious mental health condition from a health care provider.

If any one condition fails, there is no FMLA entitlement, though the Americans with Disabilities Act and other protections described below may still apply. The rules for substance use disorders overlap with these but carry extra Tennessee-specific considerations, which the companion guide on whether FMLA covers drug and alcohol rehab explains in full.

Which Mental Health Conditions Qualify for FMLA Leave?

FMLA does not list qualifying diagnoses. Any mental health condition qualifies when it meets the serious-health-condition test. The conditions below are the ones for which leave is most commonly requested.

Major depressive disorder

Qualifies as a chronic condition or where a period of incapacity requires ongoing treatment.

Anxiety disorders

Generalized anxiety, social anxiety, and panic disorder are named chronic conditions under DOL guidance.

Post-traumatic stress disorder

Qualifies for continuous or intermittent leave, including leave for trauma-focused therapy.

Bipolar disorder

An episodic chronic condition. Both acute episodes and maintenance care can be covered.

Obsessive-compulsive disorder

Qualifies where it causes incapacity and requires continuing treatment by a provider.

Eating disorders

Inpatient or residential treatment is the clearest qualifying case, named directly in DOL guidance.

Dissociative disorders

Listed by the Department of Labor as an example of a qualifying chronic condition.

Co-occurring disorders

A mental health condition alongside a substance use disorder is covered as a whole.

Does FMLA Cover Leave for Depression in Tennessee?

Yes. Major depression qualifies when it incapacitates a person for more than three consecutive days and requires ongoing treatment, or when it is managed as a chronic condition with periodic provider visits. Leave for depression is frequently taken intermittently, for therapy appointments, medication adjustments, or short periods of incapacity, rather than as one continuous block. Where depression co-occurs with substance use, both are covered, and integrated treatment for depression and addiction is the standard of care.

Does FMLA Cover Leave for Anxiety in Tennessee?

Yes. Generalized anxiety disorder, social anxiety disorder, and panic disorder are among the chronic conditions the Department of Labor names in its mental health guidance. Because anxiety often produces episodic rather than continuous incapacity, intermittent leave is common, covering flare-ups and scheduled treatment. Certification from a health care provider establishing that the condition is chronic and may cause occasional incapacity supports an intermittent-leave request.

Does FMLA Cover Leave for PTSD in Tennessee?

Yes. Post-traumatic stress disorder qualifies as a serious health condition when it meets the inpatient or continuing-treatment test. Leave can be continuous during an intensive treatment episode or intermittent for ongoing therapy such as EMDR or cognitive processing therapy. Veterans and first responders carry an elevated risk of PTSD, and dedicated care for veterans with co-occurring conditions addresses trauma and substance use together.

Does FMLA Cover Leave for Bipolar Disorder in Tennessee?

Yes. Bipolar disorder is an episodic chronic condition, and FMLA covers both acute episodes that require intensive or inpatient care and the periodic visits that maintenance treatment requires. Because episodes are unpredictable, a certification that documents the chronic and episodic nature of the condition allows leave to be used as needed rather than scheduled in advance.

Which Levels of Mental Health Care Does FMLA Cover?

FMLA covers the full continuum. The levels differ in how the leave is counted, which affects how much of your 12 weeks a course of care uses.

Inpatient and residential

The clearest qualifying case. Requires continuous absence, charged day for day.

Partial hospitalization

Structured daytime programming while living at home. Available as reduced-schedule leave.

Intensive outpatient

Charged only in hours missed. Sessions scheduled outside work hours use no FMLA at all.

Outpatient therapy

Regular appointments and medication management taken as intermittent leave, in the hours missed.

Intermittent leave is the feature that matters most for mental health. A person managing depression or anxiety who attends weekly cognitive behavioral therapy or dialectical behavior therapy uses only the hours those appointments require, which preserves the bulk of the entitlement for periods of acute need.

How the 12 Weeks Are Counted for Mental Health Leave

Three counting rules decide how much protection a course of care actually uses.

Continuous leave is charged in whole weeks

Taken as one unbroken block, 12 workweeks equals 84 calendar days, weekends included, not 90.

Intermittent leave is charged in the hours missed

Therapy appointments and short flare-ups draw down the entitlement in hours, not weeks, which is why most outpatient mental health care uses very little of the 12 weeks.

Paid time off runs concurrently

Accrued vacation or sick leave used during FMLA makes part of the leave paid. It does not extend job protection beyond 12 weeks.

Can You Be Fired for Taking Mental Health Leave in Tennessee?

Not for the leave itself, if you are FMLA-eligible and you follow the notice and certification procedure. An employer may not interfere with FMLA rights or retaliate against an employee for using them. Tennessee is an at-will employment state, which makes the FMLA anti-retaliation and anti-interference protections the primary safeguard, and it makes the written record decisive. Keep every request, certification, and response dated.

Mental health leave does not carry the added Tennessee complication that substance use leave does. The state’s voluntary Drug-Free Workplace Program and its drug-testing rules apply to substance use, not to a mental health diagnosis on its own. Where a substance use disorder is also involved, those additional rules matter, and the timing of any disclosure becomes important. The guide on FMLA and drug and alcohol rehab covers that situation in detail.

Mental Health and Co-Occurring Substance Use

Mental health conditions and substance use disorders frequently occur together. In 2024 an estimated 33 percent of U.S. adults had either a mental illness or a substance use disorder in the past year. FMLA covers treatment for both, and treating them separately tends to produce worse outcomes than treating them together. Apex Recovery Tennessee specializes in dual diagnosis care, which addresses the mental health condition and the substance use disorder in one integrated plan. A person entering that kind of care can use FMLA for the whole course of treatment, subject to the same eligibility and counting rules.

What If You Do Not Qualify for FMLA?

Many Tennessee workers fall outside FMLA, most often because their employer is below the 50-employee threshold or because they have not reached 1,250 hours in the preceding year. Three protections remain, and none depend on FMLA eligibility.

Americans with Disabilities Act

Applies to employers with 15 or more employees. A mental health condition that substantially limits a major life activity can be a disability, and a modified schedule or a period of leave may be a reasonable accommodation.

Short-term disability

Where an employer offers it, short-term disability can replace part of your income during a mental health leave. It can run concurrently with FMLA and is separate from job protection.

Employee assistance programs

Many employers provide an EAP offering confidential counseling and referrals. EAP contact is a separate step from disclosing to a supervisor.

Tennessee Mental Health Data

Job-protected leave matters because mental health conditions are common in the working-age population and because access to care in Tennessee is measurably constrained. The figures below give context.

61.5 million

U.S. adults, or 23.4 percent, experienced any mental illness in 2024.

About 1,441,000

Tennessee adults experienced any mental illness in the past year, more than a quarter of adults.

About 1 in 2

U.S. adults with any mental illness received treatment in 2024, leaving roughly half untreated.

Ranked 44th

Tennessee’s overall standing in the 2025 State of Mental Health in America report: higher prevalence, lower access.

Tennessee ranked 42nd for access to care, and the state has roughly one mental health provider for every 560 residents, with rural counties facing far worse shortages. Removing the fear of job loss is one of the few barriers to care that a worker can address in advance, which is what FMLA and the ADA are for. Apex Recovery Tennessee’s behavioral health services and its Tennessee mental health treatment programs serve people across the state.

How to Request FMLA Leave for Mental Health in Tennessee

  1. Get a clinical assessment first. The level of care you need sets the amount of leave you need. Apex Recovery Tennessee offers a free, confidential assessment with a licensed clinician.
  2. Ask human resources how the 12-month FMLA period is measured. An employer may use a calendar year, a fixed year, a forward year, or a rolling backward year. The method determines how much leave you actually have.
  3. Give notice. Thirty days in advance where the need is foreseeable, and as soon as practicable where it is not. You do not have to state your diagnosis or use the word FMLA. Enough information to show a serious health condition is sufficient.
  4. Provide medical certification. Your provider completes the certification, which asks about the nature and expected duration of the condition and whether intermittent leave is medically necessary. It does not require a specific diagnosis.
  5. Request intermittent or reduced-schedule leave where appropriate. For ongoing therapy and episodic conditions, intermittent leave preserves entitlement for periods of acute need.
  6. Keep dated copies of everything. An FMLA complaint may be filed with the U.S. Department of Labor, generally within two years of the violation, or three where the violation is willful.
